What we mean by a claim
For this page, a claim means the work we carry out to assess, prepare, submit or progress a State Pension or National Insurance enquiry that may relate to:
Where any arrears go
Any State Pension arrears, underpayment, uplift, deferred lump sum, one-off back payment or linked Pension Credit arrears arising from the claim are paid directly to you.
Hampton & Rowe is not authorised to receive, redirect or control your benefit payment on your behalf.
For an HRP claim, HMRC does not pay an agent. Where money is due after the record is corrected, DWP makes the relevant pension payment to you.
What “successful” means
A claim is treated as successful for fee purposes only when you receive backdated arrears from DWP as a result of the claim.
That can follow a correction to your National Insurance record, HRP position, State Pension entitlement, qualifying years or credits, inherited or marriage-based entitlement, deferred pension, or a linked Pension Credit adjustment.
If your record changes but no arrears are paid, no success fee is due.
A worked example
Suppose DWP awards £2,000 in arrears but deducts £300 to repay an existing debt. The net arrears actually paid to you are £1,700.
The success fee is calculated on the £1,700 you actually receive, not the £2,000 headline award.
How the fee is paid
After DWP pays the arrears to you, we may ask for the arrears breakdown, award notice or other reasonable evidence showing the amount paid and any deduction or set-off.
We then issue an invoice showing how the success fee has been calculated. Payment is due within 14 days of the invoice date, not the date on which DWP paid the arrears.
Payment can be made by bank transfer, debit card or payment link, cheque by post, or another reasonable method agreed with us.
If you need support
If you are digitally excluded, need paper copies, cannot scan documents, or need help understanding an invoice, let us know and we will provide reasonable support.
If you are worried about paying within the stated timeframe, contact us. Where appropriate, we can discuss additional time or a payment plan.
If an invoice remains unpaid, we use reasonable reminders and a final written notice before considering formal recovery as a last resort. Any action should be fair, proportionate and take vulnerability into account.
Fee summary
A note on “arrears actually received”
“Arrears actually received” means the amount DWP pays to you after any deduction it makes to recover a debt or other set-off. You are responsible for paying the success fee after those arrears have been paid to you.
If no arrears are paid to you, you pay nothing.
